Terms & Conditions
This is a contract between you (hereinafter “Client”) and Hayley Jones d/b/a City On A Hill Tours (hereinafter “Travel Agent”). Before we make any arrangements or bookings for your trip, we require that you review and acknowledge that you have read, understand, and agree to the Terms & Conditions:
Travel Documentation: Client assumes full responsibility for checking, verifying, and obtaining all necessary travel documentation for entry into the destinations in your itinerary, including, but not limited to, passports, visas, inoculation certificates, or other entry requirements. Passports must be valid for at least six (6) months after your scheduled return. Some countries require that your passport have two (2) to four (4) blank visa/stamp pages. When traveling domestically or internationally, it is recommended that each traveler carry at least two (2) forms of acceptable identification. Travel documentation requirements are subject to change, and changes or updates may not be reflected in this paragraph. It is up to the Client to check and comply with current requirements. Please consult www.travel.state.gov for more information and to verify that each traveler in your party has the necessary documentation. Please check any documentation sent to you by Travel Agent for accuracy, verifying name, date, and travel arrangement if applicable. The first, middle, and last name, date of birth, and gender of each passenger provided to the Travel Agent for booking purposes must be exactly as it appears on the traveler’s identification that will be used while traveling – no exceptions.
Travel Safety: Client assumes full responsibility for checking all conditions regarding health, safety, security, political stability, strikes and labor, or civil unrest at any and all destinations in Client’s itinerary. Travel Agent has no special knowledge regarding unsafe conditions, strikes, health hazards, weather hazards, or climate extremes at locations to which Client may travel. For information concerning possible dangers at any destination, Travel Agent recommends Client contact the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, Travel Agent recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to or living in a foreign country. STEP allows you to provide information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended. Visit https://step.state.gov/ for more information and to enroll.
Suppliers: Travel Agent is not the source or supplier of the travel services requested or booked and acts solely as a booking agent for principal supplier cruise lines, hotels, airlines, ground transportation, tour operators, destination management companies and any other companies providing accommodations, transportation, tours and/or other services (hereinafter “Suppliers”). Each of these Suppliers is an independent entity with its own management and is not subject to the control of the Travel Agent. Suppliers have their own terms, conditions, and contracts covering cancellation policies, change fees, and penalties. Client may be bound by those contracts, regardless of whether you receive notice of their terms. By signing below, you are consenting to those terms and conditions. Travel Agent has no special knowledge regarding the financial condition of the Suppliers. Travel Agent is not responsible for any acts or omissions of the Suppliers or their failure to provide goods or services or adhere to their own schedules and/or pricing. Client agrees that any recourse for such failure or event shall be with the defaulting Supplier, and not with Travel Agent. Travel Agent is not responsible for the cancellation of any service or refunds from Suppliers that may cease operations, whether temporarily or permanently, for any reason.
Travel Vouchers: Client understands and agrees that unused portions of travel vouchers are non-refundable.
Pricing: Price quotes are applicable to the date and time at which they are provided. Rates are always subject to change and are not guaranteed until booked. Quotes in foreign currency are subject to fluctuations depending on exchange rates and international credit card issuer fees. Travel Agent is not responsible for any price increases due to fuel surcharges, government-imposed taxes and/or fees, or supplier-imposed increases during travel. Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. Client hereby consents to such price increases and authorizes Client’s credit or debit card to be charged.
Scope: Only the goods and services specifically stated to be included in the offering, package, or itinerary are included in the prices quoted by Travel Agent or Supplier and/or paid by Client. Transportation to a destination or property, shore excursions, tours, side trips, lodging, food and beverage, or other goods and services not specifically stated to be included will be the responsibility of the Client.
Check-Ins and Departures: It is Client’s responsibility to reconfirm all domestic and international flight details and recommended check-in times prior to departure. Checking in later than these recommended times may result in denied boarding. Recommended check-in times are subject to change without notification. It is the Traveler’s responsibility to check airport conditions or rules that might require earlier arrival times. This information can be found when entering your confirmation number on the airline’s website. Travel Agent does not assume any responsibility for any flight or schedule changes. Please note that certain countries impose departure taxes that require payment in cash.
Overbookings and Aircraft/Vessel Changes: Flights, tours, and cruises may be overbooked, or there may be a change in an aircraft or vessel. Any person denied boarding for overbooking or aircraft/vessel changes may be entitled to a compensatory payment from the Supplier. Travel Agent cannot guarantee against and is not liable for boarding denials, fare or accommodation downgrades, or other losses caused by Supplier overbookings or changes.
Travel Protection/Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. Travel Agent is not qualified or authorized to answer questions about benefits, coverage, exclusions, or conditions of any protection plans offered or purchased, nor to evaluate the adequacy of the existing coverage. No representation or description of the insurance made by Travel Agent constitutes a binding assurance or promise regarding any insurance policy offered or purchased. For questions or more information on any plans offered or purchased, please call the number included on the travel protection quote or plan provided by Travel Agent. Unless noted, travel insurance is not included in the cost of your itinerary. Information for travel insurance will be sent to you within a reasonable time frame based on trip and components.
Vaccinations: Client assumes full responsibility to ensure that all travelers have the proper vaccinations for the destinations in the itinerary prior to traveling. Please see your health provider or a medical professional for advice regarding the necessary or recommended vaccinations and documentation thereof. Travel Agent may provide recommendations regarding potentially necessary vaccinations, but in so doing does not assume any responsibility or liability for any vaccinations or failure to receive vaccinations required for travel.
Credit Cards: We strongly recommend that you use a credit card when providing payment for travel services so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services purchased. By signing below, Client acknowledges and accepts that there are cancellation policies, change fees and penalties that apply to Client’s travel plans and services as set by Suppliers. If, for any reason, Client’s credit card charges are later declined, reversed or Travel Agent is unable to receive payment for the travel plans and services, Client acknowledges that this is a binding contract and Travel Agent will be entitled to recovery, including reasonable attorneys’ fees in connection with collection. When any Supplier is the merchant on your credit card transaction, Client agrees that Travel Agent’s services consist of facilitating the sale and paying the Suppliers, and once Travel Agent provides said services, Client agrees not to dispute the credit card charge. If a Supplier does not provide the service or ceases operations, Client’s only recourse will be against the Supplier. If a Supplier goes bankrupt, Client’s only recourse will be to file a claim with the Supplier’s bankruptcy court. If Travel Agent has any planning or service fees, these are non-refundable regardless of the trip being cancelled, delayed, or traveled. Any such planning and service fees are non-refundable.
Waiver of Liability: Travel Agent shall not be liable for any accident, injury, property damage, refund, delay, inconvenience or personal loss to Client or to those traveling with Client in connection with any travel services we have booked, including, but not limited to: acts of God, weather conditions, natural disasters, acts of government or other authorities, wars, civil disturbances, riots, strikes, epidemics or pandemics, acts of terrorism, breakdown in equipment, theft, delay, fuel increases, or cancellation or changes in itineraries or schedules. Travel Agent shall not be liable for any loss which may be caused by (1) any defaults, wrongful or negligent acts or omissions of any Supplier; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under the control of Travel Agent; and (4) any Supplier price drop after Client’s travel arrangements have been confirmed, paid in full, or ticketed.
Cancellations and Refunds: All cancellations must be submitted in writing. Any refunds are subject solely to the terms and conditions of the individual Supplier. Travel Agent does not issue refunds directly and does not guarantee the recovery of any funds. If a Supplier denies a refund request for any reason, Client understands and agrees that no refund will be provided. Refunds for credit card purchases, if available, may be issued directly by the Supplier and can take between 30 to 90 days to process. Client acknowledges that all decisions regarding eligibility for a refund rest with the Supplier, and Travel Agent shall not be held responsible for any such decisions. If Travel Agent has any planning or service fees, these are non-refundable regardless of the trip being cancelled, delayed, or traveled. Any such planning and service fees are non-refundable.
Assumption of Risks: Client acknowledges that travel carries inherent risks including but not limited to personal injury, illness, property loss, and other hazards. By booking, Client accepts all such risks voluntarily and assumes full responsibility for their consequences.
Geographic Availability and Regulatory Compliance: Travel Agent is located and operates exclusively out of the State of Tennessee, which does not require the registration or licensing of travel agents. Travel services offered by Travel Agent are not available to residents of states that require seller of travel registration, licensing, or bonding unless and until Travel Agent has complied with such requirements. These states may include, but are not limited to, California, Florida, Hawaii, and Washington. It is the Client’s sole responsibility to determine whether any registration or licensing requirements apply to their state of residence. By booking services through Travel Agent, Client affirms that they are not a resident of a jurisdiction that requires registration or licensing of travel sellers, or that they have independently determined that such requirements do not apply to their purchase. Because Travel Agent is based in Tennessee, all travel arrangements are deemed made in Tennessee, and this Agreement shall be construed as having been entered into within the State of Tennessee.
Traveling with Minors: If traveling with a minor, the Client represents that they are the parent or legal guardian of the child or have appropriate documentation demonstrating authority to travel with the minor. Certain destinations may require notarized consent letters for minors traveling without both parents.
Digital Acceptance: If booking travel services through our website or otherwise, you acknowledge that you have read, understood, and agree to these Terms & Conditions prior to booking.
Release and Disputes: Client hereby releases Travel Agent from all claims arising out of any provision covered in this agreement. Client agrees that the courts in Williamson County, Franklin, Tennessee will be the exclusive jurisdiction for all claims brought by Client or Travel Agent, and by entering into this Agreement Client hereby submits to the personal jurisdiction of those courts. This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions. In the event Travel Agent is required to take legal action to enforce any term of this Agreement, or defend any action, Client agrees to pay all reasonable attorney’s fees, court costs, and expenses incurred by Travel Agent in connection with such action.
Severability: If any provision of this Agreement is determined to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
